Retreat Booking Terms and Conditions

All participants must make themselves aware of the Terms and Conditions and each person must be responsible for taking out the appropriate insurance for the full duration of the retreat, as a condition of joining.
IMPORTANT TO KNOW
By joining us on this retreat you will take responsibility for your fitness to travel, welfare during the retreat and ability to partake in any of the activities.
Having travel insurance (including medical insurance) and signing a liability waiver is compulsory to join. You must also arrange your own transport to the retreat in Nueva Andalucia, Marbella, Spain. We may be making transfer arrangements on behalf of some participants for an additional cost but you are still responsible for this transport and we are not operating as a tour guide/leader.

1. Prices
All prices listed are per person and are all in pounds sterling. Rights are reserved to change or amend prices at any time before you have booked. Once your booking is made, deposit received, the price you received is guaranteed unless changes to the booking are made by you.
2. Travel and Travel Insurance
You are responsible for your own travel to and from the retreat. We require that you purchase travel insurance as we will not be liable for any missed time at the retreat or lost travel expenses due to the unavoidable cancellation of the retreat. You are also responsible for ensuring that your passport is valid in relation to the entry policies for Spain and/ or any countries where you are in transit. You must also ensure that you have any relevant visas required for your travel.
3. Deposits and Payments
Your booking is secured when you pay a deposit or you have paid in full for the price of your retreat ticket. There is no cooling-off period when purchasing or booking any of our retreats. Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason.
A payment plan may be available. Please contact us to discuss this possibility.
All bookings are provisional and are only confirmed when the deposit payment has been received. You HAVE Got This and Health by Evilina reserve the right to decline any booking at their discretion.
All attendees will be required to complete a booking form available at https://forms.wix.com/r/7181752435105333554. This form will also be sent when your payment is made. We recommend that you do not book your travel until after you have received confirmation from us once the booking form has been submitted. If we cancel your booking upon receipt of the booking form, we will refund the amount paid minus any service fees. If you have any questions, please email amanda@youhavegotthis.co.uk
Any refunds are subject to the Cancellation Policy detailed under Section 4 below.
4. Cancellation Policy
We appreciate whilst it is not usually the intention once signed up to cancel your attendance that things happen and sometimes circumstances beyond your control take over. We will do everything we can to help you in the unfortunate event that you need to cancel and to support this process.
This is why we have in place a 'Cancellation Policy'. This is detailed below, please note for your reference. This is also why it is compulsory for you to have comprehensive travel insurance from the time of booking this retreat to support your position in the event of any unforeseen circumstances arising.
If you need to cancel any retreat with us, cancellation fees will apply. Any notice of cancellation must be provided in writing.
Please refer to the following for a breakdown of applicable cancellation fees:
• There is a non-refundable deposit for each ticket type (this is the fee if you cancel before the date specified on your ticket that is more than 3 months before the retreat). Refer to the booking policy on your ticket.
• If you cancel within 3 months of the retreat or the date specified on your ticket, the cancellation fee will be 100% of the cost of your retreat booking.
• We may be able to offer a refund (minus the deposit) if we are able to fill your place. This will be at our discretion and our decision is final.
You are responsible for your own travel to and from the retreat. We require that you purchase travel (including medical) insurance as we will not be liable for any missed time at the retreat or lost travel expenses due to the unavoidable cancellation of the retreat.
If you choose to leave the retreat early or are asked to leave due to unacceptable behaviour (as detailed in Section 6 below) you forfeit the right to receive any refund.
5. Changes to the retreat
In the unlikely and unforeseen event that we need to significantly amend or cancel the retreat, you can choose from one of the following options:
If for any reason You HAVE Got This or the retreat providers have to cancel or change the start date of any retreat, for any reason whatsoever, you are entitled to transfer the sums paid to another retreat or programme that we offer (either scheduled or at some future time within the next two (2) years) to be used as credit.
Alternatively, you may request a refund of payments made by you to us, which will be accommodated for insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your retreat.
You may also choose to accept any significant amendments necessary to be made to the retreat.
​You HAVE Got This or the retreat providers are not responsible for your expenses incurred in preparation for any cancelled retreats such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip. This is part of the reason why we require you to purchase appropriate insurance.
We will inform you of any significant amendments to the retreat as soon as possible – this does not include itinerary changes.
We/You HAVE Got This/ Health by Evilina will not be liable for any forced cancellations or changes that stem from adverse weather conditions, acts of God, fire, floods, terrorism, civil strife or riots, war, strikes, airport closures or any other circumstance that is beyond our control resulting in force majeure. We will not have any other liability.
6. Conduct
For the comfort, enjoyment and safety of all everyone joining, it is important that everyone maintain acceptable levels of behaviour during the retreat. In the unlikely event that behaviour is deemed to be unacceptable, after due warning has been given, participants will be asked to leave the retreat and fees paid will be non-refundable. By signing up to the retreat, you are agreeing to abide by these rules.
Examples of unacceptable behaviour include (but are not limited to):
• Aggressive, abusive or disruptive behaviour to self and/or others
• Being disrespectful to other participants and/or the organisers
• Engaging in illegal activities
• Harassment or bullying, including physical and/or verbal abuse.
7. Insurance
We have public liability insurance in place covering the sessions offered during the retreat. However, it is compulsory to join that you have comprehensive travel insurance (including medical) in place at the time of booking to cover any required amendments or cancellation. We cannot be held responsible for any liability, losses, or expenses you may incur during or while travelling to or from the route. All activities (including any outside of the advertised retreat activities that are at your own expense) are undertaken at your own risk and liability.

None of the exclusions & limitations in these conditions are intended to limit any rights the client may have under statute or common law which may not be excluded, nor in any way to exclude or limit liability to the client for personal injury or death resulting from the negligence of You HAVE Got This or Health by Evilina or that of its employees, cohosts or agents, or for any liability incurred as a result of fraud or fraudulent misrepresentation by You HAVE Got This or Health by Evilina.
The client understands that attending any activity or service provided during the retreat involves some level of risk. By attending any activity or service provided by You HAVE Got This or Health by Evilina or agents or cohosts, the client agrees to assume these risks & agrees to release & discharge You HAVE Got This or Health by Evilina, employees, cohosts and agents from any and all claims for liability. Neither You HAVE Got This or Health by Evilina nor any of its Directors, employees, agents, cohosts or partners will be liable for any loss or damage to any personal property or vehicle belonging to the client during the services.
9. Your responsibilities (the guest, you, client, participant)
The retreat ticket fee does not include travel to and from the retreat. The organizer may facilitate by agreement optional airport transfer arrangements, payment for these services will need to be covered by you (the client) and we do not take responsibility for this travel. You must also ensure that you have a valid passport that meets the requirements for entry to Spain and any visa you may need for travel.
The client is responsible for their own personal medical requirements, clothing & footwear for the duration of the retreat.
It is the client’s responsibility to inform us in writing of any past, present or potential health issues that may make them unsuitable to participate in the services agreed. Failure to disclose any such information may result in You HAVE Got This or Health by Evilina terminating the contract & withdrawing the client from the services without refund, not withstanding conditions of cancellation by You HAVE Got This or Health by Evilina. If a letter of suitability is required from a guest’s medical professional, then this must be sent to You HAVE Got This or Health by Evilina a minimum of 30 days prior to a retreat start date.

It is the sole responsibility of the client to ensure that the balance for the cost of their Trip place is paid in full & on time as per the terms set out by You HAVE Got This or Health by Evilina. The full retreat fee is payable by 1 October 2024 unless agreed otherwise in writing on confirmation of booking. It is the sole responsibility of the client to ensure that their payment is made on time & by the due date, as per the terms & conditions.
10. Room Allocations
Room allocations will be made on a first come first serve basis. We cannot guarantee you will be allocated a specific room and the room you are allocated may not match the image on the website depending on room availability. However, you will be allocated a room based on the ticket type purchased.
11. Photo / Video Release – Use of Image
You hereby grant to You HAVE Got This and Health by Evilina the absolute and irrevocable right, and unrestricted permissions to use photographic portraits/images/videos in which you feature that are taken during the retreat to use/republish/copyright, etc. for commercial use in association with our services. You hereby release and discharge You HAVE Got This and Health by Evilina from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy. If you do not wish for your image to be used, you must let us know in advance of the retreat so that suitable arrangements can be made.
12. Problems and complaints
We are confident that you will not find cause for concern during your retreat and we always welcome feedback. If you feel that a complaint is warranted you must raise the issue directly with us. Any retrospective complaint must be made in writing to amanda@youhavegotthis.co.uk within 14 days of the end of your retreat. We will have 28 days from the date of receiving your complaint to respond in writing.
13. Privacy
Any personal information that we collect about you will be handled in accordance with our Privacy Policy By booking the retreat, you agree that we can contact you regarding matters related to the retreat.
14. Passport/visa requirements
As noted in section 2, you are responsible for ensuring that your passport is valid in relation to the entry policies for Spain and/ or any countries where you are in transit. You must also ensure that you have any relevant visas required for your travel.
15. Acceptance of risk
You acknowledge that the nature of the trip may be active and participation involves a degree of personal risk. You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. See the waiver for full details: https://www.youhavegotthis.co.uk/retreat-waiver
16. Other
Any charges applied for breakages in relation to the retreat premises and its contents made by a participant will be at the discretion of the organisers and where relevant will need to be paid by the participant. The organizer will pass on any reasonable costs charged by the venue owner for breakages and damages. You must advise us as soon as possible of any damages caused during the retreat and at the venue.
The retreat providers (You HAVE Got This and Health by Evilina) own the copyright and other intellectual property rights for the retreat materials and activities. This may not be copied or reproduced without our express, written consent or unless otherwise stated.
